(A) in the case of any action by an individual, such additional damages as the court may allow, but not exceeding $1,000; or

(B) in the case of a class action, (i) such amount for each named plaintiff as could be recovered under subparagraph (A), and (ii) such amount as the court may allow for all other class members, without regard to a minimum individual recovery, not to exceed the lesser of $500,000 or 1 per centum of the net worth of the debt collector.

(If a debt collector violates FDCPA,they are liable for damages not exceeding $1000 or in a class action lawsuit, not exceeding the lesser of $500,000 or 1% of the debt collector’s net worth.)

FCBA Consultation

The FCBA provides consumers with protections related to billing disputes on credit card accounts, including the right to dispute charges and request corrections.

15 U.S.C. § 1640 provides that a creditor who violates the FCBA is liable to the consumer for the following: Twice the amount of any finance charge associated with the billing error with a minimum of $500 and a maximum of $5,000 in statutory damages or a higher amount if an established pattern or practice of FCBA violations can be demonstrated.

(If a lender or a credit card issuer violates consumers’ rights under the FCBA, the latter is entitled to statutory damages of a maximum of $5,000, actual damages. One may also receive punitive damages in case the lender or credit card issuer has a track record of consumers’ rights in the same manner.)

TCPA Consultation

The TCPA restricts telemarketing calls, automated messages, and unsolicited faxes, requiring consent and offering options to opt out of such communications.

(A) an action to recover for actual monetary loss from such a violation, or to receive $500 in damages for each such violation, whichever is greater, or (B) both such actions. If the court finds that the defendant willfully or knowingly violated this subsection or the regulations prescribed under this subsection, the court may, in its discretion, increase the amount of the award to an amount equal to not more than 3 times the amount available under subparagraph (A) of this paragraph.

(If a consumer revokes consent and the debt collector continues to make calls, the collector or creditor is subject to statutory damages of $500(for any call) to $1500(for willful or knowing violations) per phone call.)

(1)(A) any actual damages sustained by the consumer as a result of the failure or damages of not less than $100 and not more than $1,000; or
(B) in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or $1,000, whichever is greater;

(If a credit bureau’s violations of the Fair Credit Reporting Act are deemed “willful” (knowing or reckless) by a Court, consumers can recover damages ranging from $100 – $1,000 for each violation of the FCRA.)
